Welcome to the Avalon East Homeowners Association Pool
 
We hope you enjoy your time at the pool and encourage you to use it often. Please be respectful of the lifeguards. They are there for your safety!
 
While using the pool, please follow the community rules and regulations. Failure to do so could result in loss of your privileges.

RULES AND REGULATIONS
GOVERNING USE OF THE SWIMMING POOL AND ENVIRONS

A.    INTENT
The following rules and regulations are intended to benefit and protect all members of Avalon East Homeowners Association and their bona fide guests, to assure the safe and sanitary operation of the pool facilities. Cooperation in observing all requirements set forth hereinafter is essential to assure the safe, pleasant, and successful operation of the pool facilities.
 
B.    SCOPE AND APPLICATION
1) The rules and regulations set forth herein shall apply uniformly to all members of Avalon East Homeowners Association as well as their tenants, guests, or invitees afforded the privileges of using the pool facilities.
2) Swimming pool privileges shall be further subject to strict compliance with all future rules and regulations as the Board of Directors may elect from time to time, to declare to be in effect; such rates and regulations to be effective whether or not the same are known to or communicated to members.
3) Members shall be accorded the privileges of bringing guests, subject to the express understanding that they are subject to these rules and regulations as well as any other rules and regulations which the Board of Directors may in the future elect to declare in effect.
4) These rules and regulations are incorporated into and become a part of the rules and regulations of Avalon         East Homeowners Association.
 
C.    DEFINITION OF MEMBERSHIP (PRIVILEGES)
For purposes of these rules and regulations, members are defined as follows:
1)  Any person or persons named on a Deed for any lot or unit of Avalon Homeowners and their partners and unmarried children or other dependents, provided they shall reside in the residence.
2)  Any person or persons named in a valid lease for one of the lots or units within the Avalon East               Homeowners Association as well as their partners, unmarried children, or other dependents residing therein.
 
D.    ASSUMPTION OF RISK
1)  All persons using the pool & facilities do so entirely at their own risk and sole  responsibility. Neither Avalon East Homeowners Association or its Board of Directors,or agents, or any employee thereof assume any responsibility nor shall be held liable either individually or severally for any accident or injury sustained in connection with such use. Members and their guests in consideration of the right to use the pool facilities, expressly covenant and agree with the Association, its governing council, and its agents arid employees thereof to make no claim against and further to protect and save the said association, its governing council, its agents and any employees thereof harmless or on account of any loss of life or personal injury or damages to or loss of personal property.
2) Any person responsible for any property damage or loss will be held personally responsible for said damage or loss and will be charged for same.
3) Neither the Board of Directors, the Managing Agents, the Pool Management Co., nor  its employees shall be responsible for any loss or damage of any personal property of any kind what so ever.
4) Avalon East Homeowners Association will establish an informal “Lost and Found” receptacle in which items found left at the pool at the close of the day shall be placed. No responsibility for safeguarding or returning these neglected items to their rightful owners is assumed by Avalon East Homeowners Association.
 
E.    SAFE CONDUCT
1) Members and their guests agree to use extreme care and caution in all acts concerning their activities to avoid mishaps to themselves and to others and to promptly report to the pool manager or the guard in charge any injuries or losses sustained or violations of these rules and regulations observed for recordation purposes.
2) All persons using the pool will abide by and actively support and assert any and all decisions made by the pool management, the life guards, or the Board of Directors or its duly authorized agent.
3) Members shall be held fully accountable for all actions of their guests, their children and for their children’s guests.
4) Members and their guests desiring to use the pool facilities may do so under the express understanding that they comply and cause for their guests to comply at all times with all laws, rules, and regulations of the State of Maryland, County of Baltimore and the United States Government as well as with the rules and regulations set forth herein in conjunction with said use and with respect to using the surrounding private property.
 
F.    ADMISSION
1) Owners and their dependents on behalf of themselves and their children, or on behalf of their tenants, who have not paid their Association assessment fees as well as any other charges incurred and assessed in conjunction with the collection thereof, will be denied access to the pool facilities, whether as a member or guests of members in good standing condition. 
2) All members and their dependents prior to admittance must, upon entering the pool facility present valid membership cards and sign themselves in the Membership Roster.
3) All guests must be accompanied by an adult member, who shall be at least eighteen (18) years of age or older and be in possession of a valid membership pass. All Guests must be signed in by the said adult member in the guest register maintained by the lifeguards.
4) Properly registered guests shall be permitted to use the pool facilities only while in the accompaniment of their adult sponsor and provided they adhere strictly to all rules and regulations set forth herein.
5) No person under the influence of alcoholic beverages or drugs (prescribed or otherwise) will be allowed on the pool premises.
6) For the safety and protection of others using the pool, admission will be denied to anyone with skin abrasions, colds, inflamed eyes, contagious conditions or infections or coughs, or to anyone wearing bandages or having any other form of obvious health hazard endangering to themselves or to others using the facilities.
7) Children that are not potty trained and/or wearing diapers are restricted to the wading pool and not allowed in the adult pool. Swim diapers or rubber pants are required in the wading pool. This rule will be strictly enforced.
8) Children under twelve (12) years of age will not be permitted within the pool compound unless accompanied and closely supervised by an adult.
9) The Corporation reserves the right to refuse entry or deny pool privileges to any member or guest for causes at its sole discretion.
 
G.    OPERATIONS
1) The swimming pool season begins the Saturday of the Memorial Day Weekend and continues through Labor Day.
2) The pool may be closed at the discretion of the Pool Management Co. at anytime due to weather, equipment failure, or operational defects or for any other cause which may endanger the health and safety of the users of the facility.
3)  Last fifteen (15) minutes of each hour of the pool on weekends may be reserved for adult swim only at the discretion of the lifeguards.      
4) There will be no advance reservation of chairs or chaise lounges.
5) Private pool parties will be permitted subject to certain conditions and restrictions.  The fee for the party will be $100.00.  There will be no charge for community sponsored events held by the association. Contact Managing Agent for further information.  
 
H.    HEALTH AND SAFETY
1)    All swimmers must wear bathing suits,
2)    All swimmers must take a shower before entering the pool.
3)    Profanity, offensive, improper or dangerous behavior is strictly prohibited.
4)    Radios must be kept low, for personal consumption, and not to be imposed on others.
5)    No smoking permitted within the fenced pool area or walkway areas leading to and around the pool. 
6)    Pets strictly prohibited on Recreation Association grounds.
7)    Bicycles, skates, scooters and skate boards must be left outside the fenced area.  Strollers are not permitted within ten (10) feet of the pool. The only wheeled vehicles allowed within the pool area are         wheelchairs
8)   Glass containers of any type are strictly prohibited within the pool compound.
9)   The use of drugs or consumption of alcoholic beverages is strictly prohibited.
10) Floating devices such as life rafts may be used subject to the discretion of the pool manager. Water wings and other supportive flotation devices can be used at the discretion of the pool manager.
11) Running, pushing, wrestling, or roughhousing are prohibited within the pool compound.
12) Absolutely no diving from the sides of the pool, or running or leaping into the pool in an aggressive manner.
13) All refuse etc, must be deposited in the proper receptacles.
14) Children under six (6) years of age will not be permitted in the pool compound unless accompanied and  under close supervision of an adult.
15) Use of the wading pool is restricted to children who are in the immediate accompaniment and under close supervision of an adult.
16) No swimming Instruction or lessons of any kind by anyone including hired life guards.
 
I. ADMINISTRATION AND DISCIPLINE
1)The pool manager, assistant manager, and other pool staff shall be responsible for conducting the operations of the pool, subject to the discretion of the Board of Directors of Avalon East Homeowners Association.
2)  The pool manager, or in his absence the assistant pool manager, shall have the authority to suspend any member or guest from use of the pool facility from one day to thirty days. Any member, however, whose privileges have been suspended for a period in excess of seventy-two (72) hours from the time of the infraction, may file a written appeal of such suspension with the Board of Directors, for a hearing on the said suspension. All privileges, however, shall remain suspended until such time as the hearing has been held and a decision has been rendered by the Board of Directors, unless each suspension period shall have elapsed prior to the hearing being held and a decision rendered.
3) Notice will be sent to the parent of any minor whose pool privileges have been suspended. Multiples offenses will result in total suspension of privileges.
4) Any person caught transferring possession of his/her membership pass or using a membership pass belonging to another, shall be denied usage of the pool for a period of thirty (30) days. Multiples offenses will result in total suspension of privileges.    
5) Any suggestions for modification of these rules and regulations must be submitted in writing to the Board of Directors of Avalon East Homeowners Association or to the managing agent. It is understood that any change hereof shall be subject to Board of Directors.
6) These rules and regulations are subject to change without written notice to each pool member, subject to conditions that the said changes have been:
    a.    Approved by the Board of Directors
    b.    Notice of such change shall have been posted in the pool office at least seventy-two (72) hours prior to implementation, unless such change shall be mandated to eliminate any endangerment to the health and safety of the members and their guests, or the safety of the facilities comprising Avalon East Homeowners Association.
